These Terms govern your use of the Will Generator on LexisGhana.com. Please read them before you begin. By ticking the box marked “I understand this produces a draft Will for a lawyer to review, not a final Will I can sign, and I accept the Terms of Use,” you confirm that you have read, understood and agreed to these Terms.
If you do not agree, do not use the Will Generator.
1. Who we are
The Will Generator is operated on Lexisghana.com, a website owned by QUASHIESAM Enterprise, a sole proprietorship owned by lawyer Kofi Amoyaw Quashie-Sam, a lawyer currently with the law firm Kwame A. Boafo & Associates, of OTA 71C Church Road-Adum, Kumasi (“we”, “us”, “our”). Legal services referred to in these Terms are provided by Kofi Amoyaw Quashie-Sam unless referred to a different lawyer. Legal services are provided by lawyers enrolled to practise in Ghana under the Legal Profession Act, 1960 (Act 32).

In these Terms, “we”, “us” and “our” mean QUASHIESAM Enterprise, which operates LexisGhana.com and the Will Generator. Where these Terms concern the provision of legal services — including the Legal Review, the acceptance of instructions, and professional liability — references to “we”, “us” and “our” mean Kofi Amoyaw Quashie-Sam, practising at Kwame A. Boafo & Associates.
2. How these Terms fit with our other policies
These Terms apply specifically to the Will Generator and to the Legal Review service offered through it. They sit alongside:
- our Terms of Service, which govern your use of LexisGhana.com generally; and
- our Privacy Policy, which explains how we handle personal information.
Where anything in those documents conflicts with these Terms in relation to the Will Generator, these Terms prevail.
3. What the Will Generator is
The Will Generator is an automated questionnaire. It asks you a series of questions and arranges your answers into the structure and language a Will conventionally takes. It then produces a printable document.
That document is a draft. Every page of it is marked “DRAFT”. It is a record of your wishes set out in an orderly form, a starting point for a conversation with a lawyer, and nothing more.
4. What the Will Generator is not
You acknowledge and agree that:
(a) It is not a Will. The document produced is not a valid or effective testamentary instrument and must not be treated as one.
(b) It is not legal advice. The Will Generator cannot assess your circumstances, cannot tell you whether your intentions are sensible or achievable, and cannot identify problems that a lawyer speaking with you would identify. Nothing it produces or displays constitutes legal advice.
(c) It does not create a lawyer-client relationship. Using the Will Generator does not make us your lawyers. No professional relationship arises between you and us unless and until we have accepted your instructions in writing and you have entered into a separate engagement with us.
(d) It is not a substitute for a lawyer. It is an aid to preparation, designed to make a professional consultation shorter and more productive.
5. Validity of Wills in Ghana
A Will made in Ghana is valid only if it complies with the Wills Act, 1971 (Act 360), including as to the manner in which it is signed and witnessed.
A document that fails those requirements may be wholly or partly ineffective, and the failure is generally discovered only after the testator’s death, when it can no longer be corrected. Neither this tool nor these Terms alter those requirements in any way.
You accept that a document produced by the Will Generator has not been checked for compliance with Act 360 and must not be signed or witnessed until it has been reviewed by a lawyer and the signing properly supervised.
6. Eligibility
You may use the Will Generator only if:
(a) you are 18 years of age or older;
(b) you are of sound mind and understand the nature and effect of making a Will;
(c) you are acting for yourself, and not completing the questionnaire on another person’s behalf;
(d) you are using it in connection with property situated in Ghana; and
(e) you intend to have a lawyer of your choice read through it before finalising and signing it.
If any of these does not apply to you, please contact us directly rather than using the tool.
7. Your information stays on your device
The Will Generator runs entirely within your web browser.
Nothing you enter into the questionnaire is transmitted to us, and nothing you enter into it is stored on our servers. Your answers are held only in your browser’s temporary storage for the current tab, and are erased when that tab is closed. We do not receive, see, retain or process the contents of your draft at any point.
This is a deliberate design decision. The information in a Will is among the most sensitive a person holds, and we have chosen not to hold it.
The practical consequences for you are that:
(a) you must print or save your draft before closing the tab, or it will be lost;
(b) we cannot recover a lost draft, because we never had it; and
(c) if you use a shared or public device, you should close the tab when you finish.
We do collect anonymous, aggregated usage statistics (for example, how many people complete the questionnaire). These contain no personal information and no content from your draft. See our Privacy Policy for detail.
8. Accuracy is your responsibility
The document reproduces what you type. Names, addresses, descriptions of property and other details are copied into the draft exactly as you enter them, and are not checked, verified or corrected.
You are responsible for the accuracy and completeness of everything you enter. Errors in names or property descriptions are a common cause of disputes after death.
Where you leave a question unanswered, the draft displays a marked gap in square brackets. A draft containing such gaps is incomplete and must not be signed.
9. The Legal Review service
You may optionally purchase a Legal Review.
(a) What it includes. A lawyer reviews your draft, meets with you for up to 60 minutes by telephone or video call to discuss it, and prepares a final version of your Will in proper form. Assistance with signing and with deposit of the Will at the High Court can be arranged separately, at cost.
(b) Fee. The fee charged through the Will generator is for the legal review only and is payable in advance. Fees are quoted in Ghana Cedis and include all applicable taxes unless stated otherwise.
(c) Payment. Payments are processed by Paystack. We do not receive or store your card or mobile money details. Your use of Paystack is subject to their own terms.
(d) When we become your lawyers. Payment alone does not create a lawyer-client relationship. That relationship begins only when we have confirmed in writing that we accept your instructions, after any conflict-of-interest and identification checks we are required to carry out.
(e) If we cannot act. If a conflict of interest, a regulatory restriction or any other proper reason prevents us from acting for you, we will tell you and refund the fee in full.
(f) Appointments. Appointments are scheduled through Calendly. Your confirmation email contains links to reschedule or cancel. One payment entitles you to one appointment.
(g) Cancellation and refunds. Cancellation of the legal review must be communicated at least 1 hour before the review session begins. You are entitled to a refund upon cancellation. We reserve the right to retain up to 10% admin fee as a cancellation charge, reflecting the reserved appointment slot and payment processing costs.
10. Third-party services
The Will Generator page uses Paystack for payment, Calendly for scheduling and Google Analytics for anonymous usage measurement. Each operates under its own terms and privacy policy. We are not responsible for their services, and their availability is outside our control.
11. Intellectual property
The Will Generator, its questions, explanatory text, styling and underlying code are our property and are protected by copyright.
The draft document it produces for you is yours. You may keep it, print it, and share it with any lawyer or adviser you choose, including a lawyer other than us.
You may not copy, reproduce, adapt or republish the Will Generator itself, or any part of it, or use it to build or train a competing service.
12. Availability
We provide the Will Generator free of charge and on an “as available” basis. We do not guarantee that it will be available without interruption, that it will be free of errors, or that it will remain available at all. We may modify, suspend or withdraw it at any time without notice.
13. Limitation of liability
(a) Nothing in these Terms excludes or limits our liability for death or personal injury caused by negligence, for fraud or fraudulent misrepresentation, or for any other liability that cannot lawfully be excluded or limited.
(b) Subject to paragraph (a), we are not liable for any loss or damage arising from:
- your use of, or inability to use, the Will Generator;
- the loss of a draft you did not save;
- any error, omission or inaccuracy in a draft arising from information you entered;
- the signing, witnessing or use of a draft that has not been reviewed by a lawyer;
- any document produced by the Will Generator being found invalid, ineffective or partly ineffective; or
- the unavailability or failure of any third-party service.
(c) Subject to paragraph (a), our total liability in connection with the Will Generator is limited to the amount you have actually paid us in connection with it. Where you have paid us nothing, we accept no liability.
(d) Our liability in respect of the Legal Review service, once a lawyer-client relationship has arisen, is governed by our engagement terms and by the professional standards applicable to lawyers in Ghana, and is not limited by this clause.
14. Indemnity
You agree to indemnify us against any claim brought against us by a third party arising from your misuse of the Will Generator, from your breach of these Terms, or from your having signed or acted upon an unreviewed draft.
15. Changes to these Terms
We may update these Terms from time to time. The version in force is the one published on this page when you use the Will Generator. The effective date appears at the top.
16. Governing law and disputes
These Terms are governed by the laws of the Republic of Ghana. The courts of Ghana have exclusive jurisdiction over any dispute arising from them.
If you are unhappy with any aspect of our service, please contact us first at info@lexisghana.com so that we can try to resolve it. We aim to respond substantively within 30 days. Nothing in these Terms affects your right to complain to the General Legal Council about the professional conduct of a lawyer at any time.
17. General
(a) If any provision of these Terms is found to be unenforceable, the remaining provisions continue in force.
(b) Our failure to enforce any provision does not waive our right to do so later or to enforce other provisions.
(c) These Terms, together with our Terms of Service and Privacy Policy, form the entire agreement between us in relation to the Will Generator.
By ticking the acceptance box on the Will Generator, you confirm that you have read and understood these Terms, and in particular that the document produced is a draft only, is not a valid Will, and must not be signed until it has been reviewed by a lawyer and the signing properly supervised.
