These Terms & Conditions govern your use of LexisGH.com and any products or services made available through the website, including legal consultations.

By accessing or using this website, purchasing a product or service, submitting information through the website, or otherwise using a service provided by LexisGH, you agree to be bound by these Terms & Conditions.

If you do not agree with these Terms & Conditions, please do not use the website or purchase any service through it.


 

1. ABOUT LEXISGH

LexisGH is a Ghanaian legal information and legal services platform.

The website provides legal information, educational materials, resources and access to selected legal services.

For the purposes of these Terms:

“LexisGH”, “we”, “us” or “our” means LexisGH.

“Website” means lexisghana.com and its associated pages, features and services.

“You”, “your” or “client” means the person accessing the Website or purchasing or using a service through it.

“Consultation” means a paid legal consultation provided by a LexisGH lawyer.

“Consultation Fee” means the fee stated on the relevant consultation page at the time of purchase.


 

2. USING INFORMATION ON THE WEBSITE

LexisGH publishes legal information to help people understand aspects of Ghanaian law and legal procedure.

Website content may include articles, guides, explanations, summaries, FAQs, decision trees, downloadable resources and other educational materials.

Unless expressly stated otherwise, information published on the Website is provided for general educational and informational purposes.

It is not intended to be a substitute for legal advice based on the particular facts and circumstances of an individual matter.

Laws, procedures and legal interpretations may change. Information published on the Website may therefore become outdated or may not apply to a particular situation.

You should not make important legal, financial or other decisions solely on the basis of general information published on the Website.

Where you require advice concerning your particular circumstances, you should obtain appropriate professional legal advice.


 

3. LEGAL CONSULTATION SERVICE

LexisGH provides paid legal consultations through the Website.

A consultation gives you an opportunity to speak directly with a LexisGH lawyer about a legal matter, explain your circumstances, ask questions and receive legal guidance.

The consultation is intended to help you:

  • understand the relevant legal issues;
  • understand applicable Ghanaian law and procedure;
  • identify possible options;
  • understand potential next steps; and
  • make more informed decisions about your situation.

The advice provided during a consultation is based on the information available to the lawyer at the time of the consultation.

You are responsible for providing complete and accurate information relevant to your matter.


 

4. CONSULTATION FEE

The consultation fee is stated on the relevant consultation page at the time of booking.

The standard LexisGH consultation fee is currently:

GHS 250

LexisGH may change its consultation fee from time to time.

The applicable fee is the fee displayed to you before payment is completed.

Payment must be successfully completed before an appointment can be booked.


 

5. CONSULTATION DURATION

The LexisGH consultation is not sold as a fixed number of minutes.

Most consultations take approximately 60 to 90 minutes to conclude.

This is an indication of the typical duration of a consultation and is not a guarantee of a particular minimum or maximum duration.

The actual duration may vary depending on:

  • the nature of the matter;
  • its complexity;
  • the amount of information that needs to be considered;
  • the questions raised during the consultation; and
  • other circumstances relevant to the consultation.

The consultation is intended to provide sufficient time to understand the client’s circumstances and provide appropriate legal guidance rather than to operate as a strict timed service.


 

6. WHAT A CONSULTATION INCLUDES

A consultation may include:

  • discussion of the facts and circumstances of your matter;
  • identification of relevant legal issues;
  • explanation of applicable Ghanaian law;
  • explanation of relevant legal procedures;
  • answers to questions;
  • discussion of possible options;
  • discussion of practical next steps; and
  • practical legal guidance based on the information provided.

The lawyer may ask questions or request additional information where this is necessary to understand the matter.


 

7. WHAT A CONSULTATION DOES NOT INCLUDE

Unless expressly agreed otherwise, the consultation does not include:

  • drafting legal documents;
  • revising legal documents;
  • preparing a formal written legal opinion;
  • filing documents;
  • court representation;
  • appearing in court;
  • negotiation with third parties;
  • communicating with another party on your behalf;
  • conducting extensive legal research beyond what is reasonably required for the consultation;
  • ongoing legal representation; or
  • other legal work requiring a separate professional engagement.

Where you require further legal services, LexisGH may discuss a separate engagement, scope of work and applicable fees with you.

Payment for a consultation does not automatically entitle you to any of these additional services.


 

8. DOCUMENTS PROVIDED FOR REVIEW

You may provide documents relevant to your consultation.

Where you want documents reviewed before the consultation, they should ordinarily be provided at least 24 hours before the scheduled consultation.

You should provide only documents that are relevant to the matter.

The consultation fee does not automatically include extensive document review.

Documents exceeding 25 pages, or documents requiring substantial additional review, may attract an additional fee.

Where an additional fee is required, LexisGH will discuss the fee with you before undertaking the additional work.

Providing a document to LexisGH does not by itself mean that LexisGH has agreed to undertake a separate document-review assignment.


 

9. BOOKING AND APPOINTMENTS

After successful payment, you will be directed to the LexisGH appointment calendar or an associated scheduling service.

You are responsible for selecting an appointment time that you can attend.

An appointment is considered confirmed when the payment has been successfully processed and the appointment has been successfully scheduled.

You should provide accurate contact information when booking.

LexisGH may contact you using the contact details you provide in connection with your appointment.


 

10. RESCHEDULING

You may reschedule a consultation once provided that you give at least 24 hours’ notice before the scheduled appointment.

Rescheduling is subject to appointment availability.

A request to reschedule does not guarantee that your preferred alternative date or time will be available.

If you reschedule less than 24 hours before the appointment, LexisGH may treat the appointment as cancelled.


 

11. CANCELLATION AND NON-ATTENDANCE

If you cancel a consultation with less than 24 hours’ notice, or fail to attend the scheduled consultation, LexisGH may treat the consultation fee as forfeited.

Where a refund is approved in accordance with these Terms, LexisGH may deduct reasonable administrative or payment-processing costs.

The consultation fee is non-refundable once the consultation has commenced.

Where circumstances outside the client’s control make attendance impossible, LexisGH may, at its discretion, consider an alternative arrangement.

Nothing in this section limits any rights that cannot lawfully be excluded.


 

12. LATE ARRIVAL

You should be ready to begin your consultation at the scheduled time.

If you arrive late, the lawyer will make reasonable efforts to use the remaining available time effectively.

A late arrival does not automatically entitle you to an extension beyond the scheduled appointment period.

Where the circumstances permit, the lawyer may allow additional time at their discretion.


 

13. RECORDING OF CONSULTATIONS

LexisGH records consultations.

Recordings may include audio and, where video is used, video and associated information.

Consultation recordings are maintained as part of LexisGH’s professional and administrative records and may be used for purposes including:

  • maintaining an accurate record of the consultation;
  • quality assurance;
  • professional record-keeping;
  • training and service improvement;
  • responding to later enquiries concerning the consultation; and
  • other purposes described in the LexisGH Privacy Policy.

Further information about consultation recordings, storage, access, use and retention is contained in the Privacy Policy.

By proceeding with a consultation, you acknowledge that the consultation will be recorded.


 

14. CONFIDENTIALITY

Information provided to LexisGH in connection with a legal consultation will be treated in accordance with applicable professional and legal obligations.

You should be aware, however, that communications made through ordinary electronic communications platforms or third-party services may involve processing by those service providers.

The handling of personal information is described in the LexisGH Privacy Policy.

Nothing in these Terms is intended to reduce any confidentiality or professional obligations that apply to LexisGH or the lawyer providing the service.


 

15. NO AUTOMATIC ONGOING ENGAGEMENT

Payment for and completion of a consultation does not automatically create an ongoing retainer or continuing engagement for further legal services.

The consultation is a defined professional service.

If you subsequently require further legal work, LexisGH may agree with you on:

  • the scope of the work;
  • the applicable professional fees;
  • the terms of the engagement; and
  • any other requirements applicable to the matter.

A further engagement may require separate documentation.


 

16. ACCEPTANCE OR REFUSAL OF FURTHER WORK

Completion of a consultation does not guarantee that LexisGH will accept further work from you.

Any decision to undertake further legal work may depend on matters including:

  • professional obligations;
  • conflicts of interest;
  • availability;
  • the nature of the matter;
  • the required expertise;
  • applicable law; and
  • other circumstances relevant to the proposed engagement.

Where LexisGH cannot accept further work, this does not affect the consultation already provided.


 

17. CONFLICTS OF INTEREST

A consultation does not guarantee that LexisGH can subsequently act for you in a matter.

Before accepting further legal work, LexisGH may undertake any conflict checks considered appropriate.

Where a conflict prevents LexisGH from accepting further instructions, LexisGH may decline the proposed engagement.


 

18. ACCURACY OF INFORMATION PROVIDED BY YOU

You are responsible for ensuring that information you provide to LexisGH is accurate and complete to the best of your knowledge.

Legal advice may be affected by facts that are omitted, inaccurate or subsequently discovered.

If material information changes after the consultation, advice previously given may no longer be applicable.

You should inform LexisGH of significant changes where you seek further advice concerning the same matter.


 

19. EMERGENCY AND TIME-SENSITIVE MATTERS

A consultation booked through the Website is not an emergency legal service.

LexisGH does not guarantee that a lawyer will be available immediately or that a consultation will take place within a particular period unless expressly agreed.

If a legal matter involves an imminent deadline, court hearing, limitation period, arrest, detention, emergency or other urgent circumstance, you should communicate the urgency when contacting LexisGH.

Booking a consultation does not by itself extend, suspend or preserve any legal deadline.


 

20. WEBSITE AVAILABILITY

LexisGH aims to keep the Website available and functional.

However, we do not guarantee that the Website will always be available, uninterrupted or error-free.

Website availability may be affected by:

  • maintenance;
  • technical failures;
  • hosting issues;
  • internet connectivity;
  • third-party service interruptions;
  • security incidents; or
  • circumstances outside our reasonable control.

Where a technical problem affects a completed payment or confirmed consultation, LexisGH will make reasonable efforts to resolve the issue.


 

21. THIRD-PARTY SERVICES

LexisGH uses third-party services in connection with the Website and its services.

These may include:

  • payment providers such as Paystack;
  • appointment scheduling providers such as Calendly;
  • cloud storage services such as Microsoft OneDrive and Google Drive;
  • communication services;
  • analytics services such as Google Analytics; and
  • video or communication platforms used for consultations.

Third-party services operate under their own terms and privacy policies.

LexisGH is not responsible for matters exclusively within the control of a third-party provider, although we will make reasonable efforts to address problems affecting services purchased through LexisGH.


 

22. PAYMENTS

Payments made through the Website may be processed by third-party payment providers.

LexisGH may receive transaction information necessary to confirm and reconcile a payment.

Payment processing may be subject to the payment provider’s own terms and policies.

You must provide accurate payment and contact information.

LexisGH reserves the right to refuse or cancel a transaction where there is a reasonable basis to believe that the transaction is fraudulent, unauthorised or otherwise improper.


 

23. WEBSITE CONTENT AND INTELLECTUAL PROPERTY

Unless otherwise stated, content published by LexisGH, including:

  • logos;
  • page designs;
  • downloadable resources;

is owned by or licensed to LexisGH and is protected by applicable intellectual property laws.

You may:

  • access the content for personal and educational purposes;
  • print reasonable copies for personal use;
  • link to LexisGH pages; and
  • share links to LexisGH content.

You may not reproduce, republish, modify, distribute or commercially exploit substantial portions of LexisGH content without prior written permission.

Where you quote a limited portion of LexisGH content, you should identify LexisGH as the source and provide a link to the original page where reasonably possible.


 

24. USER CONDUCT

  • the questions asked;
  • the circumstances known to the lawyer; and

No consultation can guarantee a particular legal outcome.

Legal proceedings, negotiations and other legal matters may involve uncertainty and outcomes may depend on facts, evidence, third parties, courts, public authorities and changes in the law.


 

28. LIMITATION OF LIABILITY

To the maximum extent permitted by applicable law, LexisGH shall not be liable for indirect, incidental, special or consequential loss arising from your use of the Website or services.

Nothing in these Terms excludes or limits liability where such exclusion or limitation is prohibited by law.

Nothing in these Terms excludes or limits any professional obligation or liability that cannot lawfully be excluded or limited.

Where a liability limitation is permitted by law, any limitation will be interpreted reasonably and proportionately having regard to the nature of the service concerned.


 

29. FORCE MAJEURE

LexisGH shall not be responsible for failure or delay in performing an obligation where the failure or delay results from circumstances beyond reasonable control.

Such circumstances may include:

  • internet or telecommunications failures;
  • power outages;
  • natural disasters;
  • serious illness;
  • government action;
  • civil disturbance;
  • widespread technical failures;
  • cyber incidents;
  • third-party service failures; or
  • other circumstances reasonably beyond control.

Where reasonably possible, LexisGH will attempt to reschedule or otherwise address affected consultations.


 

30. TERMINATION OR RESTRICTION OF WEBSITE ACCESS

LexisGH may suspend or restrict access to the Website where reasonably necessary because of:

  • misuse;
  • security concerns;
  • unlawful activity;
  • breach of these Terms; or
  • technical or operational requirements.

Termination or restriction of Website access does not affect rights or obligations that accrued before termination.


 

31. PRIVACY AND DATA PROTECTION

LexisGH processes personal information in accordance with its Privacy Policy and applicable Ghanaian data protection law.

32. GOVERNING LAW

These Terms are governed by the laws of the Republic of Ghana.

Subject to any mandatory legal right to use another dispute-resolution mechanism, disputes arising from these Terms or the services provided by LexisGH shall be subject to the jurisdiction of the courts of Ghana.


 

33. DISPUTE RESOLUTION

If you have a concern about a service, you should first contact LexisGH and provide sufficient information for the matter to be investigated.

LexisGH will make reasonable efforts to resolve legitimate service concerns informally where appropriate.

Nothing in this section prevents a person from exercising a legal right or remedy available under Ghanaian law.


 

34. SEVERABILITY

If any provision of these Terms is found to be invalid, unlawful or unenforceable, that provision shall be interpreted or modified to the extent necessary to make it enforceable where legally possible.

The remaining provisions shall continue in effect.


 

35. WAIVER

A failure by LexisGH to enforce any provision of these Terms does not constitute a waiver of the right to enforce that provision later.


 

36. CHANGES TO THESE TERMS

LexisGH may update these Terms from time to time.

When material changes are made, the updated Terms will be published on the Website with a revised “Last updated” date.

Your continued use of the Website after updated Terms take effect constitutes acceptance of the revised Terms, to the extent permitted by law.

Terms applicable to a consultation already purchased will not be changed retrospectively in a way that materially alters the service already purchased unless required by law or agreed with you.
